1. ACCEPTANCE OF TERMS

By accessing this website, making a reservation, or staying at Patio Elba, you agree to these Terms & Conditions.
If you do not agree, you must not use the website or complete a booking.
 

2. OPERATING ENTITY & DBA NAMES

Patio Elba is operated by 1657 Fernandez Juncos LLC, in affiliation with Capital Jetset LLC.
Patio Elba may conduct business under additional trade names, including but not limited to:

  • Patio Elba Suites
  • Patio Elba Hotel
  • Patio Elba Boutique Hotel

Any reference to these names shall be deemed to refer to the same operating entity for all legal and contractual purposes.
 

3. OPERATING ENTITY & DBA NAMES

A. Booking Engine
Reservations made via our website are processed through Freetobook.
By completing a booking, you agree that:

  • You are legally authorized to use the payment method provided
  • The information provided is accurate
  • You are responsible for all guests included in your reservation

B. Rates & Availability

  • All rates are subject to change without notice until confirmed.
  • Reservations are not guaranteed until payment authorization is successful.
  • We reserve the right to cancel bookings resulting from system errors, pricing errors, or suspected fraud.

C. Payment Terms
Payments are processed through secure third-party providers including:

  • Stripe
  • Authorize.net

We do not store full credit card information.
You authorize Patio Elba to:

  • Pre-authorize your card prior to arrival
  • Charge for room, taxes, fees, damages, incidentals, or violations of house rules
     

4. CANCELLATION & REFUND POLICY

Cancellation terms are disclosed at the time of booking.
Unless otherwise specified:

  • Non-refundable rates are strictly non-refundable.
  • Refund eligibility depends on the cancellation policy selected at booking.

Chargebacks filed without valid contractual basis may result in:

  • Collection efforts
  • Legal recovery costs
  • Ban from future bookings
     

5. CHECK-IN, OCCUPANCY & GUEST RESPONSIBILITIES

A. Identification
Guests may be required to present government-issued identification at check-in.

B. Maximum Occupancy
Occupancy limits are strictly enforced.
Exceeding occupancy limits may result in:

  • Immediate termination of stay
  • No refund
  • Additional charges

C. Guest Conduct
Guests agree to:

  • Comply with house rules
  • Respect neighbors
  • Comply with Puerto Rico laws
  • Avoid disruptive behavior

We reserve the right to remove guests without refund for violation
 

6. SECURITY DEPOSIT & DAMAGES

Guests are financially responsible for:

  • Property damage
  • Excessive cleaning
  • Missing items
  • Unauthorized events
  • Smoking violations

We reserve the right to charge the payment method on file for damages discovered after checkout.
 

7. NO EVENTS POLICY (Unless Pre-Approved)

Events, gatherings, parties, commercial filming, or commercial use are prohibited unless explicitly authorized in writing.
Unauthorized events may result in:

  • Immediate eviction
  • Full charge of stay
  • Additional penaltiess
     

8. FORCE MAJEURE

We shall not be liable for failure to perform due to causes beyond reasonable control, including:

  • Natural disasters
  • Power outages
  • Government orders
  • Weather events
  • Pandemics
  • Utility interruptions

No refunds are guaranteed for force majeure events unless required by law.
 

9. LIMITATION OF LIABILITY

To the maximum extent permitted by law:
Patio Elba, 1657 Fernandez Juncos LLC, and Capital Jetset LLC shall not be liable for:

  • Indirect damages
  • Incidental damages
  • Lost profits
  • Travel disruptions
  • Airline cancellations
  • Third-party service failures

Our total liability shall not exceed the total amount paid for the reservation.
 

10. THIRD-PARTY SERVICES DISCLAIMER

We are not responsible for the acts, errors, or services of:

  • Freetobook
  • Stripe
  • Authorize.net
  • RingCentral
  • WhatsApp
  • Asksuite
  • Google
  • Meta
  • OTA platforms

Use of third-party services is at your own risk.
 

11. PRIVACY

Use of this website is also governed by our Privacy Policy.

12. INTELLECTUAL PROPERTY

All website content, branding, design elements, logos, and materials are the property of:

  • 1657 Fernandez Juncos LLC
  • Capital Jetset LLC

Unauthorized reproduction or use is strictly prohibited.
 

13. ASSUMPTION OF RISK

Guests acknowledge that:

  • Hospitality properties involve inherent risks
  • Pools, stairs, balconies, and outdoor areas carry safety risks
  • Guests assume responsibility for personal safety

We are not responsible for accidents resulting from guest negligence.
 

14. INDEMNIFICATION

You agree to indemnify and hold harmless:

  • 1657 Fernandez Juncos LLC
  • Capital Jetset LLC
  • Owners, officers, employees, and contractors

From any claims arising from:

  • Violation of these Terms
  • Damage caused by you or your guests
  • Breach of law
     

15. DISPUTE RESOLUTION & ARBITRATION</p>

Any dispute arising from:

  • Website use
  • Booking
  • Stay at the property

Shall first be addressed through good-faith negotiation.
If unresolved:

  • Disputes shall be resolved through binding arbitration in Puerto Rico.
  • Arbitration shall be conducted under applicable commercial arbitration rules.
  • You waive participation in class-action lawsuits.

This provision survives termination of your stay.
 

16. GOVERNING LAW</p>

These Terms are governed by the laws of Puerto Rico.
Venue for arbitration or enforcement shall be San Juan, Puerto Rico.
 

17. MODIFICATIONS

We reserve the right to modify these Terms at any time.
Continued use of the website constitutes acceptance of updated Terms.
